Release of Liability
Wilderness Rafting Expeditions, Inc.
I for myself, my personal representatives, my heirs,
successors, executors and subrogors as well as those
of any minor child on behalf of which I have executed
the Participation Agreement and Release of Liability
hereby release and hold harmless Wilderness Expeditions,
Inc., Florida Power & Light, Central Maine Power
Company in Maine, Union Water Power Company, Bowater-Great
Northern Paper Inc., and International Paper Company,
their agents, employees, associates, successors and
assigns from any liability actions, causes of action,
and demands of every kind or nature which I or such
minor now have or which may arise out of or in connection
with my participation in any whitewater sports or
related activities undertaken in the wilderness or
river environment. I specifically waive all manner
of claims and causes of action which I or such minor
now have which may which may arise in the future against
the above names individuals and I hereby release and
discharge the above individuals from liability for
any acts or omissions or negligent conduct which may
cause, in whole or in part, any harm or injury sustained
by me or such minor as a result of my or such minor’s
participation in whitewater sports or related activities.
I agree that any manner of claims or lawsuits which
my personal representatives, my heirs, successors,
executors and subrogors as well as for those of any
minor child on behalf of which I have signed the Participation
Agreement and Release of Liability may bring against
the above named individuals shall be brought in the
State of Maine. I also agree that the substantive
law of the State of Maine shall apply to any such
claim or lawsuit without regard to the choice or conflict
of law rules of the State of Maine.
I further agree that in consideration of the above
named individuals’ permitting the minor(s) on
whose behalf I have executed the Participation Agreement
and Release of Liability to participate in whitewater,
outdoor, wilderness and river environment sports,
I shall indemnify and hold those individuals harmless
for any claims which are brought by or on behalf of
such minor(s) and which are in any way connected with
such minor’s participation in those sports and
related activities. I specifically represent that
I have authority to execute this Release of Liability
on behalf of such minor(s) and I understand that this
representation will be relied upon by the stated above
named individuals in permitting such minor to participate
in stated sports and related activities.
I HAVE READ THE ABOVE RELEASE AND BY SIGNING IT AGREE
THAT IT IS MY INTENTION TO EXEMPT AND RELIEVE WILDERNESS
EXPEDITIONS, INC., FLORIDA POWER & LIGHT, CENTRAL
MAINE POWER COMPANY, UNION WATER POWER COMPANY, IP
TIMBERLANDS OPERATION COMPANY LTD., GREAT NORTHERN
PAPER INC., A SUBSIDIARY OF BOWATER INC.; FROM LIABILITY
FOR PERSONAL INJURY, PROPERTY DAMAGE AND/OR WRONGFUL
DEATH CAUSED BY NEGLIGENCE OR ANY OTHER CAUSE.

Participation Statement And Registration
Warning: There are risks involved in whitewater sports
and in the wilderness and river environments. While
we do not wish to frighten you or dampen your enthusiasm
for whitewater sports, the wilderness on the river,
we do think it is important for you to know in advance
the dangers those risks will represent to you. These
risks and dangers are inherent in the sport, its related
activities, and the environments in which you will
engage in those sports and related activities. After
reading the description of risks and dangers inherent
in whitewater sports and the wilderness and river
environments which follows below, you be asked to
sign (1) An acknowledgement of these dangers and risks
as well as, (2) An agreement that you are assuming
responsibility for exposing yourself to these risks
and dangers. You will also be asked to sign a Release
of Liability for any harm or injury which you may
sustain as a result of your participation in whitewater
sports, related wilderness and river activities as
well as for any negligent conduct on the part of Wilderness
Expeditions, Inc., Florida Power & Light, Central
Maine Power Company, Union Water Power Company, IP
Timberlands Operating Company, Ltd., and Great Northern
paper Inc., a subsidiary of Bowater Incorporated.
In signing these acknowledgements, releases and assumption
agreements you will be giving up certain of your legal
rights including your right to sue or to recover damages
for personal injury, property damage or wrongful death.
Acknowledgement And Assumption of Risk
I understand that whitewater sports including rafting,
kayaking, swimming, wading, canoeing, boating and
related activities of the wilderness and river environment
carry with them certain risks and dangers which are
inherent in each of these activities. I understand
that those risks and dangers cannot be effectively
eliminated without destroying the unique character
of whitewater sports or the wilderness and river environments.
The specific risks and dangers involved include death
by drowning and permanent trauma or injury due to
near death drowning. The risks and dangers also include
injuries resulting from falling from a raft, canoe,
kayak or other boat into rapidly flowing water capable
of sweeping the strongest swimmer into or through
the hazards common to riverbeds such as rushing current,
rocks and boulders, waves and hydraulic systems which
can entrap a boat or swimmer. I understand that the
combination of moving water and natural conditions
may cause unpredictable consequences which may add
to or compound these risks. I further understand that
life jackets and availability of rescue equipment
are no guarantee that the risks inherent in whitewater
sports and the wilderness and river environments can
be successfully avoided and, many times, may prove
ineffective in reducing or eliminating a particular
risk. I understand that because I will be participating
in activities taking place in remote or inaccessible
areas of the river or wilderness, certain rescue opportunities
may become unavailable or ineffective. I also understand
that even the most highly trained, competent and experienced
river guide may misjudge the circumstances of the
river conditions. The result of which could be increased
risk of injury or death. I understand that equipment
failure, whether routine or extraordinary, may result
increased risk of injury or death. Both misjudgment
on the part of the river guide or failure of equipment
can substantially increase the risk of harm posed
by whitewater sports and the river and wilderness
environments. By signing below, I agree that I have
read this disclosure of the risks which I hereby agree
to assume upon engaging in whitewater sports and wilderness
and river environments. I acknowledge that I understand
the risks and significance to those risks as well
as for all injuries which I may incur as a result
of my decision to engage in these hazardous activities.
I agree that if any portion of this agreement is found
to be void or unenforceable, the remaining portion
shall remain in full force and effect.
